In March, the laws surrounding the use of mobile phones whilst driving were tightened, increasing the likelihood of prosecution if you’re caught. Previously, the law referred only to the use of phones to call and text while driving, so these changes adapt to modern smart phones and the numerous other things they can do.
What has changed?
The new law means that almost any use of a phone while driving will result in a £200 fine and 6 points on your license. Previously, it had to be proven that the phone was being used for texting or calling, so the rate of conviction was much lower.
You can still use your phone while driving in the case of a genuine emergency such as to call 999 at the scene of an accident. You can also use a phone to make contactless payments, provided the car is stationary and the goods are being immediately received, such as at a takeaway drive-thru.
You can also still use your phone as a sat nav, as long as you don’t touch it while driving and it’s not blocking your view of the road.
What is classed as “using your phone”?
Almost any use of a phone is now included in the rules, but this is the full list:
- Illuminating the screen
- Checking the time
- Checking notifications
- Unlocking the device
- Making, receiving, or rejecting a telephone or internet based call
- Sending, receiving or uploading oral or written content
- Sending, receiving or uploading a photo or video
- Utilising camera, video, or sound recording
- Drafting any text
- Accessing any stored data such as documents, books, audio files, photos, videos, films, playlists, notes or messages
- Accessing an app
- Accessing the internet
Can you use a phone while parked?
It is still illegal to use a phone in a car even if you’re stopped at traffic lights, or queueing in a traffic jam. The only time you can use a phone while in a car if not for an emergency is if you are parked up and the engine is off.
Can you rent a vehicle if you have points on your license?
